Businesses to be wary of

The FMA is committed to protecting investors from businesses who are (or have been) registered on the Financial Service Providers Register (FSPR) but are the subject of complaints about loss of investor funds, or other serious misconduct that suggests customers may lose money.

If we receive a complaint about a business or individual registered on the FSPR, we will ask for an explanation, and expect a response.

The following businesses/individuals have either not responded, or not provided a satisfactory response to a request by us for information about a complaint. 

We strongly recommend that you do not invest money through any of these businesses/individuals.

The FMA notes a warning by The Australian Securities and Investments Commission (ASIC) that Bridge Capital Advisors could be involved in a scam and is an unlicensed entity in Australia.  The warning also states that the entity makes unsolicited calls or sends unsolicited emails.

The FMA is concerned that the ‘US International Investment Trade Authority’ is claiming to be a financial services regulator and endorsing products and services from questionable sources. We are not aware of any legitimate regulators called ‘US International Trade Authority’. 
We have received a report that representatives of US International Trade Authority are cold calling New Zealand residents. We strongly advise caution when considering any financial products or companies endorsed by this organisation.

15 September 2017 A website called www.huayufx.com purports to be associated with a NZ registered company, Fe Markets Limitd.  Our enquiries have determined that Huayufx is not associated with Fe Markets Limited. It appears an unidentified third party is involved. A Hong Kong phone number is advised on the website. New Zealand residents should exercise caution dealing with Huayu International Investment.

12 April 2017 The FMA has received complaints about unreasonable or unexplained withholding of client funds by HPoption. The FMA believes HPoption is using another registered financial service provider’s details on its website without authorisation, leading investors to believe that HPoption is registered in New Zealand. The FMA would like to advise investors that HPoption is not registered on the FSPR.

19 January 2017 FMA has received a complaint from a NZ investor who claimed to have lost a significant amount of money from investing with overseas investment companies. Mergers & Acquisitions Compliance Commission (MACC) was involved in the investment process as a “regulator”, specifically in relation to offshore withholding tax matters. It is noted on the website operated by MACC that it is the primary overseer and regulator of the mergers and acquisitions industry in the USA. The U.S. Securities and Exchange Commission (SEC) website includes a list of its regional offices, and MACC is not one of them. The MACC is also not listed as part of the Federal Trade Commission. We therefore do not believe MACC is a legitimate regulator as claimed on their website.

The FMA understands that persons purporting to be involved with a UK registered company Campbell Investments Limited are offering to provide investment advice in NZ without the appropriate registration and license. Our enquiries have determined that this offer of investment advice has not been undertaken by Campbell Investments Limited or its directors nor do they operate the website www.cilluk.com. It appears an unidentified third party is involved. New Zealand residents should exercise caution if they are contacted by persons purporting to be representatives of the UK registered company Campbell Investments Limited.

17 January 2017 The FMA has received complaints that Horizon Holdings Limited is cold calling and offering investment opportunities to New Zealand residents. Horizon Holdings Limited is not incorporated in New Zealand nor registered on the FSPR therefore is not permitted to provide financial services to New Zealand residents. We note recent warning by the Hong Kong Securities and Futures Commission (SFC) in relation to Horizon Holdings Limited. SFC has advised that Horizon Holdings Limited is not located at the Hong Kong address 13 Des Voeux Road, Sheung Wan, Hong Kong as stated on the website operated by Horizon Holdings Limited. SFC has also advised that Horizon Holdings Limited uses bank accounts in Hong Kong in the names of Thompson Bright Limited, Carlyle Smith Limited and Chia Lee Trading Limited for settlement.

7 October 2016 The FMA notes that Canada’s regulator, the Financial and Consumer Affairs Authority (Government of Saskatchewan) has issued a Notice of Application to Extend a Temporary Order in which Options Rider and Option One (Aust) Pty Ltd shall cease trading in securities in Sasktachewan, cease acquiring securities for and behalf of residents of Saskatchewan and cease giving advice respecting securities in Saskatchewan.
We note that the director of Option One (Aust) Pty Limited is the director of Corporate Enterprises PTY Limited ,trading as Option Giants, about whom we have received reports of client funds being withheld. We also refer to our warning published about Options Rider in October 2015.

4 May 2016 The FMA has received reports that United Global Holdings Limited, trading as FX United, has been falsely claiming that the FMA has endorsed the company as being legitimate and highly regulated.  The FMA does not confirm legitimacy or endorse any entity in this manner. We recommend NZ consumers exercise caution when dealing with any business claiming to be endorsed by the FMA. We also note that the FMA has not frozen FX United’s accounts, as claimed in some reports.

The FMA has received complaints over the last 12 months regarding Capital One, from customers alleging that the company has failed to act on their instructions for withdrawals from their accounts.

Capital One failed to respond to a request from the FMA for information about these complaints.

Capital One was deregistered from the FSPR with effect from 30 January 2014.

NOTE: The FMA will not be able to help you to recover your money. If you are having difficulty accessing your funds you will need to contact the relevant dispute resolution scheme. Dispute resolution schemes provide a free service to help resolve any issues customers have with registered financial service providers. If the business/individual you’re dealing with is registered, the FSPR will tell you the name of their dispute resolution scheme. If they are not registered, you must deal directly with the business/individual to resolve the dispute.
