Advertising offers of financial products under the FMC Act

This guidance note explains the approach the FMA intends to take when considering advertising offers of financial products in the context of the fair dealing and disclosure requirements in the Financial Markets Conduct Act 2013.

We encourage market participants to not only follow the principles set out in this guidance, but also to consider how their conduct actively assists investors to make appropriate and considered investment decisions.

On 13 December 2021 a webinar was held for the financial markets industry entitled ”Financial Advertising and the new guidelines – Insights, understanding and opportunities”. The webinar covered both the October 2021 FMA guidance note and the new Advertising Standards Authority Code for Financial Advertising issued in November 2021.
